West of the Minish tract was the Bennett place where Tapley Bennett lived. He was the father of Captain A. T. Bennett and Hosea Bennett. This tract was later the W. C. Hood land. The old home, or house, stood near T. J. Syfan's residence where the old chimney of the original house stood for decades. These boys went to California in the Gold Rush of 1849. Captain A. T. Bennett soon returned and settled near Apple Valley where he reared a large family. Hosea remained in Arkansas. The land of Tapley Bennett joined the land of Hardy Minish and Caleb Wood on the north and Isaiah Borders on the west. The Hardy Minish tract probably ran along about the Blue Bell Overall Plant in line with the depot near the present grammar school ground, lying west of this line and joining the Bennett and Borders line. Fauquier County Court, 26th of May 1763

"We present David Thomas, Thomas Dodson, Abraham Dodson, Elisha Dodson, Joseph Dodson, Edmund Hayes, Peter Cornwell, Obed Cornwell, Alexander Higgins, & (William Davis on the Biskett Mountain), John Davis, William Carter, Timothy Stamps, John Stamps, William Stamps, Mary Stamps, John Bennett, Fortunatus Dodson, Joshua Owen, Joshua Dodson, John Creel, Rawleigh Dodson, Samuel Bailey, William Shirley, William Young, Joseph Owens, Joshua Scurlock, Edward Hughes, John Cundiff, Anthony Seale, James Shackleford, Henry Hampton, John Shirley, Joseph Morrison, Benjamin Edwards, Anthony Morgan & George Bell of Hamilton Parish for absenting themselves from their Parish Church within this six months last past."

    Census:
Alexander Lee, Thomas Bennett and John Bennett, Sr appear in order on the 1782 census list taken by John Dix in the District of Capt. John Wynn and Capt. John Walters. Alexander Lee is listed with 4 white persons in his household, Thomas Bennett with 4 white persons and John Bennett with 6 white persons. None of the three have any slaves listed.

    Will:
This will was proved on 18 July 1791. The record indicates it was further proved on 20 Feb 1797 and ordered to be recorded. This last date may not be accurate. The will was recorded in Deeds & Wills Book 9 covering the years 1791-1794. If it was recorded in 1797, as the document says, it would have been in Book 10 which covers the years 1794-1797. I believe it likely that the date the will was recorded was 1792. An examination of the wills recorded immediately before and after this one would reveal whether or not this suspicion is true. Furthermore, an inventory of the estate was submitted to the courts on 5 Mar 1792 further reinforcing the idea that the proving of the will was in February 1792.

John Bennett, Last Will and Testament
    Pittsylvania Co., Va
Deeds and Wills 9, Page 28

In the name of God Amen I John Bennett of the County of Pittsylvania and the State of Virginia planter being very sick and weak in body, but of perfect mind and memory thanks be given unto God. Calling to mind the mortallity of my body, and knowing that it is appointed for all men once to die do make & ordain this my last Will and Testament, that is to say

    Died:
In a 1794 deed from Robert Maddin to Samuel Walker, John Bennett, deceased, is identified as an adjoining property owner. (DB 8, p. 489) It is likely that John died in 1785 or 1786. John was present in the 1785 tax list of Pittsylvania County. He was absent from the 1786 land tax list and every year thereafter. In 1787 Elizabeth, John's wife, was listed as head of household on the tax list. Since only single women and widows were included on the list, it appears that John had died before 1787. His absence from the land tax list of 1786 suggests that he died sometime after the 1785 tax list was recorded.
