Notes:

Francis (c. 1648–1714), the family business agent in London. Francis and his wife Tamar, whose surnamed is not known, had at least seven children, at least one of whom, daughter Anne, survived to adulthood and married Henry Watson. Francis became a successful mechant in England and later the family sent a nephew, Richard III (son of the Scholar) to apprentice with him.

Francis was the third son of Richard Lee and Anne Constable born about 1648 at Paradise, Gloucester County, VA. He married Tamar_______. Francis died in Nov 1714 in London, England and was buried on 19 Nov 1714 at St. Dionis Backchurch (grave located in the Great Vault in the Chancel) in London, England His wife was not mentioned in his will because she had died 1 May 1694/5 and was buried in the Vault with Francis and children.

Francis was allowed the option, in his father's will, of remaining in England, if he so desired. The inference is that he was intended for a mercantile life. It is probable that he returned with his father to VA. and went back to England, to establish himself in mercantile life, some years after his father's death. The Northumberland records contain a certificate from him, dated about 1670, stating that a servant had "served his full tyme to the Estate of Col. Richard Lee and myself." A "Mr. Francis Lee" was Justice for Northumberland in 1673. Will dated 9 July 1709; probated, London, 23 Nov 1714.

Item. I give and bequeath to the five younger children, viz.: William, Hancock, Betsey, Anne, and Charles, the plantation wheron John Baswell now lives . . . including Bishops Neck and to the utmost extent of my land towards Brewer's, and also 4000 acres on the Potomac, also two plantations before bequeathed to my wife, after her death be divided between them . . . also the rest of my cattle, hogs, corn, household stuffs . . . upon said plantations (for the benefit of the listed children) . . . but the said land only to be divided among the male children (Lee, Edmunds 62-63).

Item. My will is that my horses, mares, and colts be equally divided in two parts, one whereof to be and belonging to my three eldest children, and the other to my five youngest, and shall be sold as they increase toward raising money for their portions, and in case any of the three eldest children die before they come to the age of 18 years, that then his or their portion come to the survivors or survivor of them, and in case they all died that the whole personal estate equally to return to the five youngest children, but the land only to the male children, and if the five youngest children die before they come to the age aforesaid or the females married, then their parts to be divided among the three eldest or survivors of survivor of them (Lee, Edmunds 62-63).

Hancock Lee first settled about 1675 in Northampton County where he held office, but returned to Northumberland County in about 1686 and established Ditchley. He was a justice of Northamption in 1677 and Northumberland in 1687; Burgess from Northumberland in 1688. Hancock was appointed "Naval Officer and Collector of Virginia Duties" in Northumberland County on 3 Jun 1699. He was also a vestryman for Wicomico Parish.

Hon. Richard Lee III
Richard, the oldest surviving son of Richard Lee & Laetitia Corbin, was born in 1678-9, and died in London in 1718. Somewhere about 1710-11 he had gone over to London and settled there as a Virginia merchant in partnership with his maternal uncle, Thomas Corbin. Very little information can be found concerning him. By the kindness of William Blackston Lee, Esq., the few items were copied from the London records: 1719 ............ 1724. On the 16th of November 1724, there was issued a commission to John Crabb, creditor of the late Richard Lee, late of the parish of St. Olave, Hart Street, London, but who died in the parish of St. Anne Westminister in Co.: Midd. Martha Lee, the relict and George, Martha, and Laetitia Lee, minors, children of the deceased, cited but not appearing. On the 5th of November, 1716, "Richard Lee, of London, son of Richard Lee of Couple parish, in Virgina," leased to Reuben Welch, Thomas Lee and Henry Lee, of Essex, the 2,600 acres whereupon his father had lived. "Yielding and paying therefor the yearly rent of one peper corb only on the feast day of the birth of Our Lord God." This lease is mentioned in the will of Thomas Lee. In petition from "Martha Lee, widow of Richard Lee of London," dated the 19th of October, 1720, she mentioned this lease of 1716, and stated her husband was the son of Richard Lee, Sr. & c.; gave her residence in "Goodman's Fields, parish of St. Mary White Chappel, Middlesex," England. William Lee (in 1771) stated that, Richard married an heiress in England by the name of Silk, and by her left one son, George, and two daughters, Lettice and Martha; all of these children went to Virginia and settled. George married a Wormeley, who died leaving one daughter; he then married a Fairfax, nearly related to Lord Fairfax of Yorkshire, and died leaving by his last marriage three sons, that are now minors and are at school in England under the care of Mr. James Russell. Richard 3, born in Westmoreland Co. Virginia, moved to London, married Martha Silk of England. All children born in England. After Richard 3 died at 40 years old and Martha about 15 years later, all children moved to Virginia.. Son, George moved in with his Uncle Thomas and later took possession of the home/plantation called Machodoc/Mt. Pleasant in Westmoreland Co. Virginia.

Very little information can be found concerning him. In 1719, Richard Lee died in the parish of St. Anne within the Liberty of Westminster, intestate. On the 8th of Nov 1711, William Ellins and Edmund Farrington sold to the said Richard Lee all their wares, merchandises &c. Rice Perry of the parish of St. Catherine Creechurch, London, merchant, appointed the said merchandises. Given at London 2nd January 1718-19. On the 16th of November, 1724, there was issued a commission to John Crabb, creditor of the late Richard Lee, late of the parish of St. Olave, Hart Street, London, but who died in the parish of St. Anne Westminster in Co: Midd. His father left him the 2600 acres "in Cople Parish in Westmoreland County, [it] being the land whereon I live." (Westmoreland Co. Deeds & Wills 5, 445ff.).

Martha's marriage to her first husband the much older Thomas Moore, Citizen and Distiller of London, seems to have been childless but to have brought her property which must have been attractive to Richard Lee whose business affairs were probably already in trouble at the time of the marriage. Oliver Marton is mentioned in Thomas Moore's will (see below).
After the death of her second husband, Richard Lee, Martha was faced with court action by her husband's former partner and uncle Thomas Corbin. Richard's business affairs were in total disarray, he seems to have died in 1718 and action was taken in July of that year.
In her Will PCC PROB 11/603
Martha Lee left all her property in Gracechurch Street London and in America to her son George and her property in Suffolk to her daughters. In the event of their deaths without issue her London estate was to go to the children of her deceased brother John and the children of her brother Abraham while her brother Tobias was to have the Suffolk estate. Provision was made for the care and education of her children, with Tobias Silk and William Wareham being appointed Trustees and Executors. Her 'very good friend' Oliver Marton, Tobias Silk and William Wareham were all left ten pounds each for mourning and she left five pounds each to Widow Ruth Hill and her daughter for mourning. She also left money to fulfill the wishes of Thomas Moore for a payment to Daniel Watts when he reached the age of twenty one. The Trustees were asked to take the advice of Oliver Marton. Job Mathew, Oliver Marton and ? Marton were the witnesses to the will which received probate on 5 May 1725, having been written on the 26 April 1725.
Thomas Moore is the son of Thomas Moore and Phillipa. He was born on 14 Sep 1647 in Littleton, Middlesex, England. Occupation 1710 in London, England (Citizen and Distiller). He died Mar 1710. Will on 15 Mar 1710 in London, England.

Litigation undertaken in 1714 involved Richard Lee in a dispute relating to a loan for £1000 from a widow called Jane Platt, secured against 58 hogsheads of tobacco. This places him as living at Savage Gardens together with John Adamson who gave a sworn deposition in the case. It may be that Savage Gardens was a business address since he also had a house at Plaistow in East London (not far from Stratford Langthorne) and his wife owned property in Goodmans Fields.

Richard Lee died intestate and after his death Thomas Corbin pursued a court action relating to a partnership of 1706, which reveals that in about September 1716 Richard Lee, faced with probable or actual bankruptcy and owing money to various people and large amounts of tax on imported tobacco, absconded from his house taking with him the account books of the business and possibly also various bills and goods.
His brother-in-law Tobias Silk testified that he was owed money and also that various of Richard Lee's household goods including beds and chairs had turned up later, from where he did not know, and had been given to Richard's widow Martha. Tobias Silk, his wife and fellow defendant Thomas Muspratt, Tobacconist, all denied knowing whether Richard Lee has absconded deliberately in order to defraud Thomas Corbin and sued for their own legal costs.
John Adamson, the former clerk at the counting house testified that he believed that assignments to James Gilbert Ironmonger and John Salter Linen Draper were made fairly and did not include property owing to Thomas Corbin. His testimony creates the impression of increasing tension arising between Corbin and Richard Lee despite the account books and dealings at the Counting House being open to him, and that eventually Richard Lee refused to see Corbin who was 'very passionate' as a result Adamson agreed to keep Lee's whereabouts secret from Corbin. It seems as if Corbin suggested that a salary increase to £50 a year for Adamson was because he acted on Lee's part and against Corbin. Adamson also claimed that the Paderborne and Hessian linen which Corbin claimed had been stolen from him had in fact been distrained by the Exchequor and sold to cover unpaid tax.
Gilbert and Salter produced detailed statements relating to the assignments made by Richard Lee in his attempt to clear his debts to them and various others.
The general impression is of a business that has got into a complete muddle over unpaid tax, monies owed on goods traded and failing relationships. We do not know the cause of Richard Lee's death, but the stress of all this must have contributed.

Richard Lee, III did NOT have a brother named Richard Henry Lee. Richard Henry Lee, Signer was the son of Thomas Lee and Hannah Harrison Ludwell! I tried to get the information about Richard Henry Lee from another researcher corrected but they declined to do so. Richard Lee, III is NOT Richard Henry Lee either. The signer was the first in the Lee family with the middle name of Henry.

Oak Hill
When the first settlers began to clear the area where you live, in the 1730's, Fairfax County had not yet been carved out of Prince William County to the south. Lord Fairfax's agent, Robert "King" Carter, had given out large tracts of land for settlement to various individuals, who in turn usually leased or sold portions of their grants to people who wanted to start farms. All these grants have been plotted and overlaid on a map of modern Fairfax County by Beth Mitchell. she further discusses them in a Fairfax County History Publication called Beginning at a White Oak which accompanies the map.

In trying to trace the ownership of Oak Hill Farm we are concerned with three of these grants or patents as they were called. The first is called the Piney Ridge tract which belonged to Robert Carter, Jr. As you will see from Beth Mitchell's map, your house would appear to be in this tract.

However, I can find no Carter leases for that tract in Prince William, Fairfax or Loudoun County records. We might expect to find them in these three places, because in 1742 Fairfax County was carved out of Prince William; and, in 1757, Loudoun County was separated from Fairfax. For forty years, from 1757 to 1797, the area west of Difficult Run, where your farm is, was part of Loudoun.

As Beth Mitchell points out, those early surveys of the patent boundaries were not always too accurate by our standards, so it would appear the Carter's grant should be a little farther north than it has been placed on her map, which puts you in the Awbrey-Tayloe-Turberville grant. Before we leave Piney Ridge, however, you might be interested to note that on Mrs. Mitchell's overlay map Wet Ox Road runs straight along the patent boundary between Carter and Tayloe. There was quite a drawn-out lawsuit over the division of the tract among Carter's heirs; and, according to an 1822 survey made in connection with this, Ox Road is shown looping to the south of the boundary at one point, very possibly where the abandoned road runs in front of your house. ( Proceedings in Land Causes, Vol. 2, p.135)

This brings us to the grant in which your house is located immediately to the south of Carter's Piney Ridge. This property was first granted to Francis Awbrey in 1725. He sold it to Colonel John Tayloe in 1730, and Tayloe sold it to George Turberville at a date yet to be discovered. Turberville had a 4,142 acre patent adjoining Tayloe's to the south, which also comes into the story and into which some of your farmland today may fall.

LANDOWNERS AND THEIR TENANTS

As you may remember, Sallie Lane Lewis' Uncle Ben Higgs told her that "Oak Hill" had been given to another Sally Lane, born almost 200 years ago, by her father William Lane when she married Benjamin Higgs in 1816. Therefore, I was looking not only for leases on the site of your house from the land grant owner, but for a Lane purchase of the land.

In his will, recorded on page 110 of Fairfax County Will Book J-1 on February 11, 1808, William Carr Lane, Sr., did indeed "give and bequeath to my daughter Sally Rooles (alternate spelling of Rowles) 298 acres of land called Oakhill and including to make up that quantity 83 acres which had been leased by John Turberville to my father James Lane.....also the following slaves: Beck and her infant, Jack, Henry and Anna, also the furnishings which were part of her dowry." William Carr Lane, Sr., had several other children to whom he gave like portions, so you can see he was one the prosperous landowners of that time. The inventory of his estate, also recorded in Will Book J-1, beginning on p. 224, shows him to have been the owner of 33 slaves valued at over $6,000 and personal property such as farm equipment and household furnishings valued at almost $9,000.

Since Lane mentioned his father James Lane had leased land from the Turbervilles, I looked to see if he might have acquired the land on which your house is built. The only early entry was in Price William County Deed Book E on page 146, which showed that James Lane leased a 142-acre plantation on which he was then living from From George Turberville in 1740. This was on Turberville's 4,142-acre tract to the south of Awbrey-Tayloe.

There were three other leases for small plantations (150 acres apiece) recorded by Turberville on that tract at almost the same time, one to a William Lane, who was probably James' brother or cousin. These leases were usually given for three lives: those of the husband, his "present" wife (because women so often died in childbirth in those days, I think), and the eldest son if there was one. This practice is very useful to us today. In the case of James Lane we can match up the names of the wife and son to be sure we are following the same person.

The James Lane who leased from Turberville in 1740 had a wife named Lydia and a son named Aaron. The Major James Lane whose will was probated in Loudoun County in 1794 (Will Book B, pp. 212-214) had a wife (still) named Lydia and a son named Aaron, as well as sons Moses, James, Jr., and William and several daughters.

James Lane was the only one of the four 1740 lessees who eventually bought his plantation. His son William Carr Lane had to go to court to get the title transferred and recorded (Fairfax County Deed Book E-2. p. 466), which leads us to an 18th century practice which is not helpful today.

They were sadly negligent about recording title transfers. There are several of William Carr Lane's land holdings acquired from Turberville listed in the Fairfax County Tax Rools of 1798-1816 for which I can find no purchase deeds, including the two which make up the 298 acres of Oak Hill Farm. The basic tract of "land called Oakhill" under Lane's name in the 1798 tax rolls was 213 acres acquired from Turberville and valued at $2.41 an acre.

The 1797 and before Loudoun County tax rolls, which might tell us when he bought it, are unfortunately dim and illegible on microfilm, although the originals in the State Library at Richmond might be more readable. We can be sure this is the "land called Oakhill" (1) because it is the only tract of the acreage (in 1805 the listing changed to 215, perhaps they took a survey), and (2) because in 1811 after Lane's estate had been settled, this land was transferred from his name to that of Joseph E. Rolls (Rowles), his son-in-law, along with 83 acres subtracted from a 335 acre tract "from Turberville", for which there is likewise no sale or lease in the records.

Again going back to Miss Lewis' information, you may remember that Joseph e. Rowles died of typhus in Georgetown in 1811. In 1814, the Land Tax Records show "oak Hill Farm" as the property of the heirs of Joseph Rolls, who are "scattered", and in 1816, their "place of residence is not known."

Richard Henry Lee (January 20, 1732 – June 19, 1794) was an American statesman from Virginia best known for the motion in the Second Continental Congress calling for the colonies' independence from Great Britain. He was a signatory to the Articles of Confederation and his famous resolution of June 1776 led to the United States Declaration of Independence, which Lee signed. He also served a one-year term as the President of the Continental Congress, and was a United States Senator from Virginia from 1789 to 1792, serving during part of that time as one of the first Presidents pro tempore.

Lee was born in Westmoreland County, Virginia to Thomas Lee and Hannah Harrison Ludwell Lee on January 20, 1732. He was raised Episcopalian and came from a line of military officers, diplomats, and legislators. His father, Thomas Lee, was the governor of Virginia before his death in 1750. Lee spent most of his early life in Stratford, Virginia with his family at Stratford Hall. Here he was tutored and taught in a variety of skills, and witnessed the very beginning of political career as his father sent him around to neighboring planters with the intention for Lee to become associated with neighboring men of like prominence. In 1748, 16, Lee left Virginia for Yorkshire, England, to complete his formal education at Queen Elizabeth Grammar School, Wakefield. Both of his parents died in 1750 and, in 1753, after touring Europe, he returned to Virginia to help his brothers settle the estate his parents had left behind.

In 1757, Lee was appointed justice of the peace in Westmoreland County. In 1758 he was elected to the Virginia House of Burgesses, where he met Patrick Henry. An early advocate of independence, Lee became one of the first to create Committees of Correspondence among the many independence-minded Americans in the various colonies. In 1766, almost ten years before the American Revolutionary War, Lee is credited with having authored the Westmoreland Resolution which was publicly signed by prominent landowners who met at Leedstown, Westmoreland County, Virginia on 27 February 1766. This resolution was signed by four brothers of George Washington as well as Gilbert Campbell.

In August 1774, Lee was chosen as a delegate to the First Continental Congress in Philadelphia. In Lee's Resolution on the 7th of June 1776 during the Second Continental Congress, Lee put forth the motion to the Continental Congress to declare Independence from Great Britain, which read (in part):

Resolved: That these United Colonies are, and of right ought to be, free and independent States, that they are absolved from all allegiance to the British Crown, and that all political connection between them and the State of Great Britain is, and ought to be, totally dissolved.

Lee had returned to Virginia by the time Congress voted on and adopted the Declaration of Independence, but he signed the document when he returned to Congress.

Richard Henry Lee was elected the sixth President of Congress under the Articles of Confederation on November 30, 1784, in the French Arms Tavern, Trenton, New Jersey. On January 11, 1785, Congress convened in the old New York City Hall and Lee presided over that Congress until November 23, 1785. Although, he was not paid a salary for his office as president, his household expenses were paid by Congress in the amount of $12,203.13.

Lee's Congress was most active in 1785, passing numerous legislation, including establishing a United States dollar tied to the Spanish dollar as the national currency. His most pressing issue, however, was to settle the states' territorial disputes over the Northwest Territory. Throughout his term, Lee remained steadfast that the release of states’ territorial claims on the Northwest Territory would enable the federal government to fund itself with land sales. He believed that the urgency of this measure was paramount because borrowing more foreign money was no longer prudent, and he abhorred the movement to establish federal taxes. The sale of these vast federal lands, he concluded, was the nation's only hope to pay off the war debt and adequately fund federal government. Debate began on the expansion of the Ordinance of 1784 and Thomas Jefferson’s survey method “hundreds of ten geographical miles square, each mile containing 6086 and 4-10ths of a foot” and “sub-divided into lots of one mile square each, or 850 and 4-10ths of an acre" on April 14.[4 ] On May 3, 1785, William Grayson of Virginia made a motion seconded by James Monroe to change “seven miles square” to “six miles square”, and the current US Survey system was born. Lee wrote to his friend and colleague Samuel Adams:

I hope we shall shortly finish our plan for disposing of the western Lands to discharge the oppressive public debt created by the war & I think that if this source of revenue be rightly managed, that these republics may soon be discharged from that state of oppression and distress that an indebted people must invariably feel.

The states relinquished their right to this "test tract" of land, and the Land Ordinance of 1785 was passed on May 20, 1785.

The federal government, however, lacked the resources to manage the newly surveyed lands because Native Americans refused to relinquish a large percentage of the platted land, and most of the territory remained too dangerous for settlement. This either required troops to eject the Native Americans or capital to purchase their land "fairly", insuring the peaceful sale and settlement. Additionally the small amount of federal land that was not in dispute by the Native Americans was enthusiastically being occupied by western settlers that had no faith in or respect for the Congress as a federal authority. The settlers claimed the land as squatters, and the Congress was unable to muster the capital to magistrates let alone troops to enforce the $1.00 per acre fee required for a clear federal land title. With the states no longer in control of the lands and no federal magistrates or troops to enforce the laws, a tide of western squatters flowed into the Northwest Territory. Lee's plan to fill the federal treasury with the proceeds of land sales failed, but the survey system developed under the Land Ordinance of 1785 is still used today.

Richard honored his brother, Francis Lightfoot Lee (another signer of the Articles of Confederation and the Declaration of Independence), by naming his youngest son after him.

The younger Francis married Jane Fitzgerald on 9 Feb 1810. In 1811 he purchased the estate Sully in Fairfax County, Virginia from his second cousin Richard Bland Lee. Jane died on 25 Jul 1816, shortly after the birth on their fifth child.

Henry Lee III (29 January 1756 – 25 March 1818) was an early American patriot who served as the ninth Governor of Virginia and as the Virginia Representative to the United States Congress. During the American Revolution, Lee served as a cavalry officer in the Continental Army and earned the name Light Horse Harry. He was also the father of Confederate general Robert E. Lee.

Lee was born near Dumfries, Virginia, the son of Henry Lee II (1730–1787) of "Leesylvania" and Lucy Grymes (1734–1792) the "Lowland Beauty." His father was first cousin once removed to Richard Henry Lee, sixth President of the Continental Congress. His mother was an aunt of the wife of Virginia Governor Thomas Nelson Jr. His great-grandmother Mary Bland was a great-aunt of President Thomas Jefferson and he descended once from King John of England, twice from King Edward I of England, once from King Jean de Brienne of Jerusalem, twice from King Edward III of England and once from King Pedro I of Castile.

Lee graduated from the College of New Jersey (now Princeton University) in 1773, and began pursuing a legal career. With the outbreak of the Revolutionary War, he became a Captain in a Virginia dragoon detachment, which was attached to the 1st Continental Light Dragoons. In 1778, Lee was promoted to Major and given the command of a mixed corps of cavalry and infantry known as Lee's Legion, with which he won a great reputation as a leader of light troops. It was during his time as commander of the Legion that Lee earned the sobriquet of "Light Horse Harry" for his horsemanship. Lee was presented a gold medal–a reward given to no other officer below a general's rank– for the Legion's actions during the Battle of Paulus Hook in New Jersey, on 19 August 1779.

Lee was promoted to Lieutenant Colonel and was assigned with his Legion to the southern theater of war. Lee's forces served at the Battle of Guilford Court House, the Battle of Camden and the Battle of Eutaw Springs. He was present at Cornwallis's surrender at Yorktown, but left the Army shortly after due to an illness. During the infamous Whiskey Rebellion, Lee commanded the 13,000 militiamen sent to quash the rebels.

Between 8-13 April 1782, at "Stratford Hall", Lee married his second cousin, Matilda Ludwell Lee (1764-1790), who was known as "The Divine Matilda". Matilda was the daughter of the Hon. Philip Ludwell Lee, Sr., Esq. and Elizabeth Steptoe. Matilda had three children before she died in 1790;

From 1786 to 1788, Lee was a delegate to the Continental Congress, and in the last-named year in the Virginia convention, he favored the adoption of the United States Constitution. From 1789 to 1791, he served in the General Assembly and, from 1791 to 1794, was Governor of Virginia.
In 1794, Lee accompanied Washington to help the suppression of the Whiskey Rebellion in western Pennsylvania. A new county of Virginia was named after him during his governorship. Henry Lee was a major general in the U.S. Army in 1798–1800. From 1799 to 1801, he served in the United States House of Representatives of the Congress. He famously eulogized Washington to a crowd of 4,000 at the first President's funeral on December 26, 1799 —"first in war, first in peace, and first in the hearts of his countrymen."
The Panic of 1796-1797 and bankruptcy of Robert Morris reduced Lee's fortune.

On 27 July 1812, Lee received grave injuries while helping to resist an attack on his friend, Alexander Contee Hanson, editor of the Baltimore newspaper, The Federal Republican. Hanson was attacked by Democratic-Republican mob because his paper opposed the War of 1812. Lee and Hanson and two dozen other Federalists had taken refuge in the offices of the paper. The group surrendered to Baltimore city officials the next day and were jailed. Laborer George Woolslager led a mob that forced its way into the jail and removed and beat the Federalists over the next three hours. One Federalist, James Lingan, died.
Lee suffered extensive internal injuries as well as head and face wounds, and even his speech was affected. Lee later sailed to the West Indies in an effort to recuperate from his injuries. He died on 25 March 1818, at Dungeness, on Cumberland Island, Georgia.
Lee was buried with full military honors provided by an American fleet stationed near St. Marys. In 1913 his remains were removed to the Lee family crypt at Lee Chapel, on the campus of Washington & Lee University in Lexington, Virginia.

The Whiskey Rebellion
In the history of Southwestern Pennsylvania there have been many noteworthy personalities, but who are they and what did they do to catch our attention? One of them is Henry Lee III, who was born in Virginia on January 29, 1756 to Maj. Gen. Henry Lee II, and Lucy Grymes. Lee’s family tree includes links to America’s founding fathers and European royalty. He graduated from the College of New Jersey (Princeton) and when the Revolutionary War began, he was a Captain in a Virginia dragoon detachment. He was next given the rank of Major and the command of a corps of cavalry and infantry called “Lee’s Legion.” For his horsemanship he was known as “Light Horse Harry.” He was made Lt. Colonel and he served in three major southern battles, ending at the British surrender at Yorktown . Lee’s first marriage was to Matilda Ludwell and they had three children. She died in 1790. In 1793 he married Anne Hill Carter and she bore six children, the fifth child being Robert Edward Lee (1807-1878), who became a Confederate general in the Civil War. Lee served in the Continental Congress, where he favored the adoption of the United States Constitution. From 1791 to 1794 he was Governor of Virginia. In July, 1794, only 5 years after the United States Constitution was ratified, President Washington was truly called upon “to protect and defend the Constitution of the United States.” Distraught farmers in Washington County, Pennsylvania organized themselves as rebels to repeal the federal law that they register their stills and pay an excise tax on whiskey. Washington tried to negotiate a peaceful solution, but when the radicals persisted, he would not let their treason, politics or bloodshed splinter the Constitutional unity of the United States. The President proclaimed on September 20 that military action was needed to remove the rebellious leaders. Some 13,000 men from four states quickly responded to his call to arms. By the end of September, the federal army’s march reached Carlisle, and on October 4 Washington joined them there. On October 11, the President went to Cumberland to review the troops coming from Maryland and Virginia . On the nineteenth, all met at Bedford. Here Washington turned the command of the troops over to General “Light Horse Harry ” Henry Lee. Lee, still the Governor of Virginia, was given executive orders “to suppress opposition to the law, by military force and judicial process.” The President then returned to Philadelphia , and the troops marched in two columns toward Parkinson’s Ferry, (Monongahela, in Washington County) which was the epicenter of the farmer’s rebellion. Lee led the southern column and by November 1, they arrived in Uniontown. Gen. John Neville and Secretary of the Treasury Alexander Hamilton were in this group. Col. Presley Neville was in the northern column. On November 8 Lee issued a proclamation that the troops were there because the people of the United States were determined to uphold the new government they had just constituted. Lee identified to Gen. William Irvine the leaders of the rebellion who were to be arrested, and on November 12, in what has been called “The Terrible Night” several score citizens were arrested. The march of eighteen insurgents to Philadelphia for trial soon followed. Violence was minimal so on November 17, John Neville and others began to reopen their tax offices. Lee ordered most of the troops to return to their own homes. To maintain peace in and around Pittsburgh, Gen. Daniel Morgan was placed in charge of small detachments of troops. On Christmas Day the 20 captured rebels arrived in Philadelphia for their court trial. Lee pardoned many local insurgents on November 29, except David Bradford from Washington County, who had earlier fled to New Orleans. President Washington pardoned those who had been tried in Philadelphia. The Whiskey Rebellion was now over. The excise law was rescinded in 1802 by President Jefferson. After the Whiskey Rebellion, Lee became a member of the United States House of Representatives where he wrote the phrase “first in war, first in peace, and first in the hearts of his countrymen” in his oration on Washington at the President’s death. In the financial panic of 1796, Lee was reduced to poverty and he was temporarily placed in debtor’s prison. In 1812 Lee was beaten while helping to defend the editor of a Baltimore newspaper from a mob because the paper opposed the War of 1812. Lee suffered internal and head injuries. He went to the West Indies in an attempt to heal the wounds. He died on March 25, 1818 and he is buried in the Lee crypt in the Lee Chapel, Washington and Lee University, Lexington, Virginia.

Colonel Anthony Walke II (1726 - 1779) was the son of Colonel Anthony Walke I. Colonel Walke II was one of the wealthiest Virginians of his day, a great advocate of social drinking, extravagant social gatherings, gambling, and horse racing. When trouble with England began, as a member of the Virginia House of Burgesses, he espoused the cause of the colonies, and united with Patrick Henry, Mason, Madison, Marshall, Jefferson, and other patriots in resisting British oppression and in establishing American independence. He married Jane Bolling Randolph (1729-1756) who was a direct descendant of Powhatan, the most powerful chieftain in Tidewater Virginia at the time of the arrival of the Jamestown settlers in 1607. This strain in her blood could account for her children’s horseback riding abilities. Reverend Anthony Walke was the only surviving child of these parents. After she died, Col. Walke II married Mary Mosely and had several children: William Walke (1762 - 1795) (who is buried on the property at Ferry Plantation), Edward Hack Walke, John Basset Walke, Mary Walke, Frances Walke and Anna Walke.

Anthony Walke, the 2nd, son of Anthony Walke 1st, and Anna Lee Armistead, was born Jan 3, 1726. He married, first, Jane, daughter of Richard and Jane (Bolling) Randolph . . .b. 1729, d. 1756, m. 1750, and left issue by her, the Rev Anthony Walke, the 3rd, an Episcopal clergyman.

He married second, Mary Moseley, daughter of Col. Edward Hack Moseley and Mary Bassett, on May 8, 1757, and had issue: sons, Wm., Edward Hack, and John Bassett; daughters, Mary, Frances and Anna.

Col. Anthony Walke the 2nd, was a man of wealth and liberality. He gave the land and built at his own expense, a church edifice about 12 miles from Norfolk, in Princess Anne county, Virginia, known as "Old Donation Church." (now in ruins 1897)

Col Anthony Walke, 2nd, is buried at "Greenwich," Princess Anne County, Va., one of the Moseley seats.

General Robert Edward Lee 1807-1870
Civil War Confederate General.

He is remembered for leading the Army of Northern Virginia to the brink of victory in the Civil War. Born to a Virginia family of nobility but little money, his father was Revolutionary War General, Virginia Governor, and Congressman Light Horse Harry Lee, his mother was Ann Hill Carter Lee of the distinguished Carter family, and his Lee collateral relatives included two signers of the Declaration of Independence.

By the time young Robert arrived his father's financial irresponsibility had reduced the family to poverty and after Harry spent 1809 in debtor's prison the Lees moved to a small house in Alexandria where they were reduced to living on family charity. Harry was injured in an 1812 Baltimore political political riot and abandoned his family; Lee studied in Fauquier County and at Alexandria Academy and was to develop both studious habits and strong Christian faith, though he was not confirmed in the Episcopal Church until age 46. He also developed an abiding shame over the actions of his father's later years; indeed it is said that Lee lived his own life in an attempt to atone for Light Horse Harry, and whether that be true or not he never named any of his own sons Henry or Harry.

In 1824 Lee received an appointment to West Point via the intervention of William Henry Fitzhugh, a relative who had often provided material aid. From the time he entered the Academy in 1825 he had an outstanding record, never being charged with a demerit and graduating second in the class of 1829 to Charles Mason, later a noted attorney but now remembered only as the answer to the trivia question "Who beat Robert E. Lee at West Point?". Following graduation he was assigned to the Corps of Engineers, the norm for students with good academic records, duty carrying prestige but little promotion opportunity. While he was on leave he experienced the trauma of having his mother die in his arms in August of 1829 but he was soon off to build forts on the the Georgia coast.

In 1831 Lee was transferred to Fort Monroe, Virginia, and soon married Mary Custis, great-granddaughter of Martha Washington, whom he had been courting since 1829. The wedding took place only after the Custis family relaxed their opposition to Mary's romance with the disgraced Light Horse Harry's son; the Lees were devoted to each other and the union produced seven children though it was in some ways an unhappy match that Lee never objected to temporarily escaping when sent on assignment. Duty at Fort Monroe proved an unpleasant experience marked by staff conflicts and in 1834 Lee was posted to the Washington office of the Chief of Engineers. In 1837 he was sent west where he distinguished himself by vastly improving Mississippi River navigation especially at St. Louis and at the Des Moines Rapids near Keokuk, Iowa.

Promoted to captain for his work along the Mississippi he was sent to Brooklyn in 1842 to become post engineer of Fort Hamilton where he worked on improving coastal defense. Lee made a number of structural improvements in the New York City area and earned praise but by 1846 he had 17 years in the Army and was still a captain with a family to support and little chance for advancement. Opportunity, however, was at hand and on August 19, 1846, Lee received his orders to report to General John Wool in preparation for service in Mexico. After traveling by ship to New Orleans, he then moved on to Texas where he joined up with General Wool. Lee and a Captain Fraser were in charge of road building on the advance into Mexico and did their jobs well, though progress was made easier by the lack of enemy contact.

On January 16, 1847, he was ordered to report to General Winfield Scott who was then preparing to assault Vera Cruz. When he arrived near Vera Cruz, Lee was made a part of Scott's inner circle of officers; working for him were Lieutenants P.G.T. Beauregard and George McClellan, while other staff officers with whom he had dealings included Joe Johnston, U.S. Grant, George Meade, and Gustavus Woodson Smith, all names that would become well known years hence. Lee participated in the battles of Vera Cruz, Contreras, and Churubusco, then was wounded at Chapultepec, his reconnaissance missions along the way proving essential to ultimate success. Along with Beauregard and McClellan, he assisted in preparing for General Scott's entry into Mexico City; at the end, though he had been acclaimed and had earned three brevet promotions for gallantry, he still held the permanent rank of captain. After the conflict, he was sent to Baltimore as chief engineer then in 1852 returned to West Point as Superintendent with the rank of Brevet Colonel. Lee proved a popular and able executive while gaining experience that was to prove valuable in the post-Civil War years. He had a reputation for interacting well with the students and was to be a particular influence on Cadet and future General J.E.B. Stuart.

In 1855 Lee was finally to achieve "real" promotion, a two-grade jump to Lieutenant Colonel, though at the price of leaving the Engineers, when he was posted to Texas as Executive Officer of the Second US Cavalry serving under Colonel Albert Sidney Johnston. Though he was happy and successful, he found himself recalled to Arlington upon the October 10, 1857, death of his father-in-law George Washington Parke Custis. As the health of Mary Lee had steadily declined, Lee was stuck with sorting out the problems of the estate. Mr. Custis had large holdings but even larger debts and further had left a poorly drawn holographic will making financial bequests which there was no money to pay.

Arlington Hall itself was left to Lee's eldest son George Washington Custis Lee, known as "Custis", who would one day serve as a Confederate Major General and who in 1882 would successfully sue the federal government and gain financial compensation for the taking of Arlington during the conflict. In the course of the settlement Lee was to make arrangements for the emancipation of Mr. Custis' slaves, though he was to also ensure that they would be able to support themselves once free.

In October of 1859 Lee received a message via Lieutenant J.E.B. Stuart calling him from Arlington to Washington to deal with the capture of the armory at Harper's Ferry, Virginia, by anti-slavery activists led by John Brown. Under orders from President Buchanan and taking with him J.E.B. and a detachment of US Marines commanded by Lieutenant Israel Green, Lee departed by train for Harper's Ferry. On the morning of October 18th J.E.B. delivered the final surrender demand then gave the signal for Green's men to take the engine house, which they accomplished rapidly. When Brown was hanged on December 2nd, the event was carried out by Virginia Militia led by David Addison Weisiger, later a minor Confederate Brigadier General, while security was provided by V.M.I. Cadets under the command of Mexican War veteran Major Thomas Jackson, then called behind his back 'Tom Fool' but one day to be written down in history as 'Stonewall'. Lee returned to his duties in Texas but storm clouds were brewing and after Texas seceeded from the Union and U.S. Army facilities were turned over to the Confederacy he was recalled by General Scott to Washington in February 1861, there to be promoted to Colonel and offered general's stars along with command of the Union Army. A staunch Unionist and not a defender of slavery, Lee wanted to see the nation preserved but he was unwilling to invade the South to accomplish that end.

Virginia seceeded on April 17, 1861; Lee resigned his commission on April 20th and was appointed Brigadier General in the Confederate Army on May 14th then the next month was named the third senior of the original five officers of four star rank. (The lineal list was Samuel Cooper, Albert Sidney Johnston, Lee, Joe Johnston, and Beauregard with Bragg, Kirby Smith, and Hood to follow later in the war). Initially tasked with training and arming Virginia troops, Lee conducted the essentially failed expedition into the western counties today called the West Virginia Campaign, then was sent to take charge of preparing coastal defenses in the lower southeast, doing a good enough job that his forts essentially held throughout the war. Returning to Richmond where he was already considered a failure after the western operation, he supervised the digging of trenches around the capital, earning himself the derisive title "King of Spades".

In February of 1862 he paid $200 for a gray gelding whom he named Traveller (using the British spelling) and rode for the rest of his life, though in periods of illness he sometimes used his smaller and tamer "other horse" Lucy Long, a gift from J.E.B. Stuart. Lee served as miliary advisor to President Davis until General Joe Johnston was wounded at the Battle of Seven Pines on May 31, 1862. Command of the Army of Northern Virginia devolved upon General Gustavus Woodson Smith who suffered a nervous breakdown within 12 hours, leading Davis to place Lee in the top spot. He had his work cut out for him; the Confederacy had suffered multiple defeats, the public held no confidence in him, and McClellan was about four miles east of Richmond (at roughly the present location of Richmond International Airport) with an Army far larger and better equipped than anything Lee could muster.

He organized the Seven Days Battle, a series of six late June engagements that only contained one clear cut victory, John Bell Hood's June 27th assault at Gaines' Mill, and cost numerous lives but ended with General McClellan bottled-up on the James River and no longer a danger to Richmond. Lee next turned his attention to Northern Virginia where from August 28th to 30th, with much help from Longstreet and Jackson, he routed General John Pope at Second Manassas; during this operation Lee fell and injured his hands, limiting his riding ability. The time of Second Manassas also marks the first recorded appearance of Lee's chest pains, then called "rheumatism", but in retrospect symptoms of the coronary artery disease that was to mark the rest of his life. Lee then moved into Maryland hoping to gather supplies, recruit new troops, and perhaps strike a blow into the northeast that would dampen the North's willingness to fight; his efforts were derailed by the famous Lost Order No. 191 which gave away his plans to McClellan; on September 17, 1862, the armies met at Sharpsburg in the Battle of Antietam which resulted in roughly 26,000 combined casualties, still the greatest one day loss of life in American history.

Withdrawing to Virginia after the drawn battle he organized his troops at Fredericksburg to meet the new Army of the Potomac commander Ambrose Burnside; on December 13, 1862, Union troops were sent up the side of Mayre's Heights into a fortified position held by James Longstreet, thus ending thousands of lives and Burnside's brief tenure in command. Longstreet was soon sent to Southside Virginia on a foraging expedition and thus as spring came Lee was missing a third of his Army. In late April he moved toward Cancellorsville, just west of Fredericksburg; between April 30th and May 6th Lee stopped Joe Hooker in the series of conflicts known collectively as the Battle of Chancellorsville, though at the cost of the May 2nd mortal wounding of Stonewall Jackson in a friendly fire incident. Lee next marched into Pennsylvania to meet the Union Army under its new commander George Meade. The entire operation which culminated in the Battle of Gettysburg was controversial at the time and will likely remain so forever, with whole books written about each day and questions asked as to whether he should have replaced Jackson with Richard Ewell, whether he should have followed Longstreet's suggestions, whether he should have ordered Pickett's Charge, and indeed whether he should have gone north in the first place.

In the aftermath Meade was unable to persue as the victorious army was in virtually as bad a condition as the defeated one. Once back in Virginia, Lee's health was poor, and knowing he bore the onus of failure, he offered to resign. The President, however, had nobody to replace him with. Interestingly, Gettysburg was not then seen as "final" in the way later generations viewed it thus Lee again reorganized and in the spring of 1864 staged the Wilderness Campaign, initially without Longstreet who after Gettysburg had been temporarily detached to General Braxton Bragg in Tennessee. Victories he won, albeit with the loss of men and supplies he could not replace; his main problem, however, was that the Union Army was now under the command of General U.S. Grant, thus denying to Lee the advantage of fighting the timid or incompetent. Forced into a nine month siege at Petersburg, he held out until finally compelled to retreat on April 2, 1865.

During the stalemate, Lee was named General-in-Chief of the Confederate States Army on January 31, 1865, and pushed for the integration of black soldiers into the Army. The Cause, however, was lost and Lee finally had to abandon the line at Petersburg. Over the next week as he moved west, he attempted to obtain food and supplies and to link up with what little was left of the Army of Tennessee, now under Joe Johnston in North Carolina. Finally on April 9, 1865, Lee was out of alternatives and surrendered to General Grant at the McLean House in Appomattox, Virginia. He delivered the surrender himself rather than send a subordinate as he knew of the sense of insult his father had felt when the British made their capitulation at Yorktown via the most junior officer present, and that only after a sergeant had been rejected by George Washington.

After the war, the men had to get back to whatever life they could salvage; the South had to be rebuilt, and Lee had to feed his family. His respect in the South was undiminished and though he faced the threat of legal action job offers came in, some of which could have made him wealthy. Desiring, however, to help restore the country's prosperity in October 1865 he accepted the presidency of the then-small Washington College in Lexington, Virginia. Revered by students, faculty, and the local populace, he proved an effective administrator; in 1868 a move was made to have him run as the Democratic candidate for Governor of Virginia. Lee knew he could win but he enjoyed his job and desired to remain where he was preparing a new generation. Further, he probably suspected that his heart was not up to the rigors of political office. He kept active when he could, walking and riding his horses, but as time went on it became obvious that Lee was aged beyond his years; he was able to travel some, going to Baltimore and visiting President Grant at the White House in the spring of 1869.

In late March of 1870 Lee undertook a two month trip thru the South during which he visited the graves of his father and of his daughter Annie and bade farewell to old friends. Upon his return he consulted with doctors in Richmond and Baltimore who did for him what little they could; he also spent time with Edmund Valentine who was in the process of creating the statue that would cover his tomb. The sculptor had wanted to meet with Lee in the fall, but apparently sensing that his final deployment was at hand the General instructed him not to wait. When the fall school term began Lee was at his post; during his years in Lexington he had worshipped and served as a vestryman at Grace Episcopal Church which was pastored by his old Chief of Artillery General William Nelson Pendleton.

On September 28th he was in his capacity as Senior Warden conducting a vestry meeting when he suffered a stroke. The General made it home on his own but was obviously quite ill; over the ensuing days he was cared for by physicians and seemed to rally at times, though at others he was unable to speak coherently. On October 12th Lee uttered the last words, "Strike the tent", and died. His wife Mary, in poor health for years, followed him to the grave in 1873, while at his death his son Custis became president of what would one day be Washington and Lee University. After the war Lee had taken the Oath of Allegiance and applied for his pardon, but for some reason his paperwork was lost and remained so until 1970; in 1975 his American Citizenship was posthumously restored by President Gerald Ford. Today Fort Lee, Virginia, carries his name, as does a multitude of counties, schools, towns, bridges, and city streets. Statues of him adorn his grave, Stone Mountain, Georgia, Monument Avenue in Richmond, and numerous other public places, while his image has been on a Virginia license plate, several US postage stamps, and continues to hang in thousands of homes. Lee has been the subject of countless biographies ranging from works for small children to those intended for academics, with the definitive being Douglas Southall Freeman's four volume "R.E. Lee" (1934-1935). For a quiet man General Lee left a large number of quotes and while no single one can define him perhaps this comes close: "Do your duty in all things...you cannot do more...you should never wish to do less".

Eldest son of John Lee and Susannah Guthrey
1766-1825
John Lee, Sr., son of Charles Lee and Ann Dabbs of Cumberland Co., VA, removed from Cumberland Co., VA, to Campbell Co., VA, and, among other interests, founded the Town of Leesville, VA. John married 1) Susannah, surname believed to be Guthrey because all records point that direction but no record of his marriage has been found. He married 2)Frances, surname believed to be Early. Again, no record of this marriage has been found either and no definitive proof that Guthrey and Early were indeed surnames of John's wives. John left the most of his estate to his eldest son, Maj. Burwell Lee,
Sr. In John's LWT, he says " I give to son Burwell Lee the land and plantation whereon I now live lying and being in the County of Campbell and lying on the north side of Goose Creek and Staunton River it being part of the tract of land I purchased from Jacobus Early with the following exceptions to wit that part called Darby's field lying in the north side of Goose Creek at Darby's Ford and adjoining the lands of Jesse Leftwich and others and one hundred and twenty eight acres taken off said tract for the town of Leesville at the junction of Goose Creek and Staunton River which leave a balance of two hundred and forty six acres, I also give my son Burwell Lee the tract of land I purchased of Robert Owen adjoining the land I now live on and above named lying on the east side of the same containing one hundred and thirty five and a half acres and deeded to me by said Owen, also two negro men named Daniel and Garnett with other necessaries I have heretofore given towards housekeeping upon his complying with some other items hereafter named . . ." John also says in his LWT "I further desire and direct in consequence of my giving to my son Burwell Lee the negro man Daniel that he may be with his wife and children that my said son Burwell Lee pay four hundred dollars
towards raising the twelve hundred dollars for my daughter Sophia." Although slavery was wrong, the Lee family did try to keep the slave families together. He also gives " to my son Burwell Lee all the town of Leesville on the west side of the Third Broad Street from Goose Creek to him and his heirs forever, excepting the land adjoining the mill seat half of which 2 acres with mill seat, I reserve for my estate and allotted for common mill. . . I appoint my son Burwell Lee and my son-in-law Robt Clark and my son-in-law James Lancaster and my son- in-law John Arnold, executors . . . . s/John Lee" According to land records, Major Burwell, Sr., owned, at one time, almost 1000 acres in Bedford and Campbell Counties, VA. I do not know exactly how many slaves he owned at one time but the division of his estate show he owned 18 at that time. Burwell Lee, Sr. married Rebecca Nancy (Ann) Arnold daughter of Moses and Elizabeth Arnold of Cumberland Co., VA. Burwell Lee served in the War of 1812. His obituaries give small detail about his life. Nancy (Ann) Arnold, wife of Major Burwell Lee, Sr. was great-
granddaughter of William and Elizabeth Arnold of Cumberland Co., VA, and I would like to include some background regarding her ancestry which is included in the Addenda of this biography. Major Burwell Lee, Sr., and Nancy (Ann) Arnold had the following children:

Reverend Anthony Walke (1755 - 1814) was the son of Colonel Anthony Walke II. He married Anne McColley McClenahan on January 15, 1776 and had six children: Anne M., Edwin, Jane Eliza, David Meade, Susan, and Anthony IV (1778 - 1820). On July 13, 1805, five months after Anne died, he married Anne Newton Fisher (1774 - 1840). They had three children: John Newton, Thomas, and Lemuel. They are all buried in the old burial ground in what is now Fairfield's subdivision, in unmarked graves.

Reverend Walke was 20 years old in the early winter of 1775 when he most likely witnessed troop movements and battles between Continental Army troops and Virginia Governor Lord Dunmore’s Loyalist troops (people who supported King George III) in battles at Kemp's Landing, 2.5 miles north and then at Great Bridge, 9 miles south of his Fairfield Manor House. The Revolutionary War (1775–1783) caught Reverend Walke at a time when he was coming of age into a Virginia gentry threatened by the loss of political power, wealth, and social prestige made possible by English control over the Virginia Colony. In his writings he blamed the north and their foolish Boston Tea Party actions.

Reverend Walke was a representative to the Virginia Constitutional Convention, and after the Revolutionary War, in early 1788 he was ordained a priest of the Episcopal Church in Philadelphia, and then served the following year as an elector from the State of Virginia to the first presidential election held in Philadelphia. Returning to Princess Anne County, Reverend Walke, with a large inheritance from his father, presided as rector over Lynnhaven Parish Church for many years without a salary (from 1788 to 1800 and again from 1812 to 1813).

Reverend Walke divided his time between preaching and the hunt. Not only was he noted for delivering sermons with a captivating mild mannered voice, but a more picturesque side of him was his love of fox and deer hunting. He conducted sermons with his horse Silverheels tethered near the door of the church. When he heard those hunting horns, he would immediately turn the service over to his clerk, Dick Edwards, and hurry off on Silverheels, not seen again until late in the day.

CAPTAIN BURWELL LEE, JR., son of Major Burwell Lee and Ann Arnold, was born 1800 and died 1872 Pittsylvania Co., VA. He married first, Matilda Arnold, who was his first cousin, and daughter of John Arnold and Patsy Lee. Matilda died 15 March 1843 and left Burwell with 7 children to raise. Matilda's obituary was published 4 April 1843 in the "Lynchburg Virginian". Burwell quickly married secondly, Elizabeth Purcell, daughter of Thomas Purcell and Lucy Brown, on 27 November 1843. Thirdly, he married the widow, Mildred (Dillard) Doyle on 12 October 1857. Burwell was an honored man in his community. He had established himself and was doing very well until the Civil War. He donated land for the Leesville Methodist church as well as land for erection of a school in the Town of Leesville, VA.. It appears that Burwell Lee, Jr. and family were living with the elders Lees or on their property in Campbell Co., VA, until about 1853. Capt. Lee was a Justice of the Peace for Campbell Co., VA. On 18 November 1853, Burwell purchased 115 acres in Pittsylvania Co., VA, from the Walden family and then on 23 November 1853, Burwell purchased an additional 270 acres on the Staunton River from Richard H. Wal[d]ton, et al. From a manuscript by Thelma Howell Bennett dated 1983 - "Grandfather Lee built his home in 1859 on land received from his father, (Burwell Lee, Jr.) and located in Pittsylvania County across the river from Leesville, VA. It was a one and one-half story, L-shaped clapboard house with four bedrooms, kitchen and dining room. A picket fence surrounded the vegetable garden, and hollyhocks and roses grew in profusion around the yard. There were some large Osage orange trees and walnut trees at the back of the house. There was also a large orchard of apples, pears, and plums.” This home overlooked the Staunton River.

The 1860 Castle Craig census shows Burwell with real estate valued at $4000.00 and a personal estate valued at $24500.00 and, herein, starts the real downturn in the family wealth and increased hardships that came to them as a result of the Emancipation Proclamation. After the Emancipation Proclamation in 1862, life for Burwell Lee, Jr., and his family just began to get worse. The land was worn out, the cheap labor was gone, and their Confederate money was useless. Gentleman planters had to learn how to survive on their own now and many had large families.

On 23 January 1863, Burwell and his third wife, Mildred sold 121 acres on Main Road to Lynchburg near Pannill‘s stables for $1334.95 to Morton Pannill. Also on this same date, they sell to Abner Anthony, Jr. 332 acres Plumbtree Branch adjoining the main Lynchburg for $3665.05. One month later, Burwell and Mildred sell an additional 133 acres to Walter Nagle for $600 on waters of Ralph Branch. Their 1/5 interest in the lands of Dr. Lynch Dillard consisting of 200 acres was also sold to John W. Motley on 22 December 1864. Burwell has now sold 453 acres of land in order to raise some cash.

In order to raise more cash, Burwell sold to son to Jeremiah A. Lee of Pittsylvania Co. on 12 December 1866 recorded 26 December 1866 - 200 acres - $1500 - tract of land lying and being in the County and State aforesaid upon the waters of Staunton River and the waters of Jaspers Creek… containing about 200 acres be the same more or less to have . . ." s/Burwell Lee. (Note Jeremiah, in turn sells this land on 11 August 1884 recorded 8 September 1844 to brother Robert A. Lee for $500.00 - who in turns sold it on 31 August 1884 to Griffin Dobyns for $1000.00.) He then sold another 186 acres to son Robert A. Lee on waters of Staunton River on 1 January 1866. (Note Burwell has now sold a total of 839 acres.)

As things began to be increasingly difficult, Burwell Lee on 26 May 1869 signed a Deed of Trust, with son Robert A. Lee as trustee to Virginia T. Lee, Lucy E. Lee, Eli Parker, Pannill and Franklin and Jeremiah A. Lee. This deed shows that Burwell, as guardian, owed Lucy $1250 since 1858; Eli Parker $100 since 1867; Pannill and Franklin $50 since 1869 and Jeremiah Lee $100 since 1869. Burwell now has put up his land containing 420 acres on Staunton River all his farm animals, plantation tools, household and kitchen furniture, crops and sorghum mill. Burwell was to remain in quiet and peacable possession of the said tract or parcell of land…until default be made. The note was due 1 April 1870. He apparently could not meet the due date of the trust and so……………… in 1870, Burwell is shown with real estate valued at $3500 and a personal estate of $700. His personal wealth has shrunk $23,800. He has little cash left now and most of his property is gone.

On 4 June 1871, Burwell, under the Homestead Law, claimed 276 acres on the waters of Staunton River and Jasper’s Creek which he assessed at the price of $6.00 per acre for a total of $1600. He also included the following articles say one old desk and bookcase one sideboard one bureau three bed and bedsteads and furniture, one gray mare, filly, all of which I value at the sum of two hundred and fifty dollars.

Burwell Lee, of Leesville, Campbell County, Va. Mrs. Lee had been in bad health for several years but had apparently improved, so much that thoughts were entertained that she would recover; but, about two months before her death, she grew worse, but did not excite serious apprehension until within a week or ten days before her death, which occurred on Wednesday morning, the 15th of March 1843 ________ aged 41 years, 3 mos. _____ religion while young, ______ we have _______________ woman; as a wife, devoted to the interests and happiness of her companion; as a mother, prudent, exemplary and affectionate, as a neighbor, perfectly unobtrusive; and it has not been the lot of many to have so few enemies. But inscrutable are the ways of providence. She has been called hence leaving to mourn her absence, one of the kindest husbands, and seven children, and we hope that the want of her counsel in the domestic circle, and her vacant seat at the table will prove a daily admonition to her family, and be sanctified to the salvation of every member, white and coloured, and that they may follow her as she followed Christ, and finally meet in the Kingdom of Heaven.
