    Notes:

    On Route 792 in Mount Airy, Pittsylvania County, Virginia, stands thelovely old home of Jesse Mustain. Presumably, he built it on the 200 acres he inherited in 1792 from his father, Thomas. Although there have been several additions, particularly that of the right wing, the old house is obviously of eigthteenth century construction. The first floor is built of eighteen-inch stone walls and has two great end chimneys. The timbers are pegged together, the wainscoting and floors are of heart pine, and the mantels have been hand-carved. On the first floor two curving corner stairways lead to the two rooms on the second floor. Two small windows flank the chimneys from a third floor plasteredroom.

    Thomas Mustain, father of Jesse, was born about 1725 and is first recorded in Halifax County in 1750, when he appeared on the tax list of William Caldwell and was living on 'the Little Roanoke River up the Fork.' In 1752 he was one of four men to appraise the estate of Isaac Cloud. On Feb 5, 1753, Thomas Mustain received his first grant of land from King George II of England, signed by Robert Dinwiddie. It consistedof 400 acres on Poplar Branch of Mill Creek, in Halifax County, Virgininia, which became part of Pittsylvania County when the latter was created in 1767. The land he left to his son, Jesse, was not part of this grant, however, as Thomas sold this 400 acres to William Payne on September 12, 1782 for 30 pounds of then current money. But, Thomas had received another grant of land from King George II, again signed by Robert Dinwiddie, on November 26, 1756. This grant was again for 400 acresin Halifax County, but was located on both sides of Stinking River. For this land grant Thomas paid 40 shillings. And it was from this grant of land he bequest 'To my son Jesse, 200 acres to be taken off the upper end of the tract where I now live.'

    Thomas and his wife, Mary, had nine daughters: Anna, who married William Buckner; Mildred, who married Jesse Keesee; Tabitha, who married James Bruce; Winifred, who married Zachariah Lewis; Seluda, who marriedClaiborne Shelton; Rebecca; Mary, who married Jeremiah Barker; Polly,who married John Patterson; Sarah, who married Price Skinner. The couple had only two sons: Jesse, who married Jane, the mother of his ninechildren, and shortly before his death, Mary Bruce; and Avery, who married Mary Barber Shelton.

    Jesse, the oldest son of Thomas and Mary, was born in 1749. He married his first wife, Jane, about 1776. Jane was the mother of his five daughters and four sons: Susannah, married Walker Goodwin; Tabitha, married Meredith Jennings; Winifred, who never married, and served as overseer of the poor of Camden Parish; Priscilla, married William Shelton; Saluda; John, who married Elizabeth LeGrande Glenn; James W, who married Sarah H Shelton; Thomas, who married Martha Irby; and Jesse, Jr,who married Tabitha Hicks.

    Jesse must have been a character, as we find in the Pittsylvania Court records at least two cases in which he is reprimanded for misbehavior as follows:

    On September 21, 1779: 'Jesse Mustain with John Oliver & Richard Toddhis securites...acknowledged themselves severally indebted to the Commonwealth of VA...Jesse Mustain in the sum of 500 lbs....on condition that the said Jesse Mustain shall be of good behaviour and keep the peace towards all citizens of this Commonwealth 1 whole year and a day'.And in October of 1782: 'Thomas Doss and Salley, his wife, against Jesse Mustain. In Trespass, assault and battery. The parties having agreed..dismissed.'

    Jesse remarried on June 11, 1793, to Mary Brewis [Bruce], but the marriage was short lived as he died the following June. The children, still minors, were left to the care and guardianship of their uncle, Avery Mustain, and their lovely new home was sold to settle their father's estate. Benjamin Gosney purchased a tract, including the dower of Mary Mustain, Jesse's widow. And in 1803, he purchased the property from Avery Mustain, the guardian of the minors, for 114 pounds and 11 shillings. This Benjamin Gosney was later to become the father-in-law ofAvery's son, Joel Mustain. Joel married his daughter, Mary Gosney, ten years later. In all likelihood, Benjamin's wife, Mary 'Elizabeth' Haden, whom he married on December 26, 1786 in Campbell County, was thesister of Jane, first wife of Jesse. Elizabeth was the daughter of John Haden, and the granddaughter of Anthony Haden of Campbell County, Virginia, and John had a daughter, Jane, as well.

    Notes:

    The grave is on a farm that was once owned by the Poole Family. It is on Rockford School Road between Route 40 and Ray Mill Road, on the right about 300 yards if you turn left off of Ray Mill Road from Route 40. There is an old tobacco barn in far left hand side of field near woods. The grave yard is located at edge of woods behind barn.

    On this 22 . day of August 1832 personally appeared in open Court before David H. nd Clark, Wm S. Pannill, Coleman D. Bennett & John A. Clark the Court of Pittsylvania County now sitting Avery Mustain a resident of Camden Parish in the County of Pittsylvania and State of
    Virginia aged 76 years who being first duly sworn according to Law doth on his Oath make the following declaration in Order to obtain the benefit of the act of Congress passed June 7 1832. That he was born 26 February 1756 near where he now lives, about 1 June 1776 he th st volunteered under Thomas Dilliard [Dillard] Capt., John Heard Lieut, Robert Dalton Ensign and marched to Guyns [sic: Gwynn] Island Va near the mouth of the Peanketank [sic: Piankatank] River and assisted in driving off Lord Dunmore, the then Governor of Va [11 July 1776]. There was no officer of higher grade than Capt. on the side of the River he was stationed. While there an express arrived and he marched with his Company to the Tennessee River in the [now] state of Tennessee against the Cherokee nation of Indians. in this expedition Heard was Capt. (Capt. Dilliard having thrown up) Dalton was Lieut. & Turly [sic: Tully] Choice Ensign. After arriving at
    New London Va. [in present Campbell County] they were attached to the command of Colo. Charles Lewis of Albemarle Va. He forgets his Maj’r. Capt. [Joseph] Martin (afterwards Gen’l. Martin of Henry Cty Va.) commanded a company in the expedition. After arriving on the Holston
    River, Colo Wm Christian being the oldest officer was first in command. after arriving in the Indian Territory (the enemy having deserted their homes) they burnt up their Houses and Corn and Eat their Potatoes. all of his Company returned thence home. No discharges were given and all returned with their Captain a few days before Christmass 1776. About the first of May 1780 he was drafted to go to the South. Isaac Clement Capt (forgets the name of Lieut. and Ensign) he marched by Peter Perkins on Dan River Va where he met several companys, by Hilsboro [sic: Hillsborough] N.C. where he met with manny troops and the following officers, General [Edward]
    Stevens who was the Commander, Colonels Richerson [sic: Holt Richardson] & [Ralph] Faulkner and Maj’r Henry Conway. thence he marched towards Camden S.C. crossing the Big & Little Peedee [sic: Pee Dee] and a few miles this side of Camden he met with General’s [Horatio] Gates, DeKalb and [William] Smallwood and next day was in the Battle in which the Americans were defeated [Battle of Camden, 16 Aug 1780]. He then returned home about the last of August 1780 and received a discharge. In February 1781 he volunteered under Gabriel Shelton Capt., James Waid Lieut. & Vincent Shelton Ensign. Capt Shelton left his company and he was then commanded by Capt Thomas Smith, crossed Dan River at Boyds Ferry, crossed Haw river in North Carolina & after marching to & fro for a while returned home after being absent 4 or 5 weeks & was not in the Battle of Guilford [15 March 1781]. In August 1781 he was drafted to go to the siege of York Town Va [28 Sep - 19 Oct 1781]. William Dix Capt., David Hurt Lieut, Clem McDaniel Ensign. after arriving at York Town, Capt Dix was succeeded by Capt. Charles Willliams. He assisted in raising breast works & Batterys; after the surrender of Lord Cornwallis, he was detailed and marched to Nolands Ferry on the Potowmac [sic: Potomac] river with the Prisoners and at Leesburg he received a discharge about the last of November 1781 which he has lost. He hereby relinquishes every claim whatever to a Pension or annuity except the present and declares that his name is not on the Pension roll of the Agency of any state – Sworn to and subscribed the day and year aforesaid – Avery Mustain
    NOTE: On 18 Mar 1839 Mary Mustain, 74, applied for a pension stating that she married Avery Mustain in March 1783, and he died 31 Aug 1833. A typed summary states that her maiden name was Mary Barber. With her application is a family record with the names and dates of birth of their children and apparently some grandchildren.

    Background – This record was written on the inside cover of Avery Mustain's 1801 bible and submitted as part of his Revolutionary War pension application. It helped establish that he was married to Mary and that as his widow she would be eligible for a pension payment.

    The record lists (1) his children and (2) his grandchildren through his oldest daughter, Saludy. It is assumed that Clark H. Moore is the grandson mentioned in Avery's will as Clark Mustain. Based on Clark’s birth in 1807 and Saludy's age, she is the only one of Avery’s children who could be the mother. Saludy didn't marry Samuel Dalton until 1809, two years after Clark was born. Clark's father is unknown as is whether he married Saludy (or died soon after conceiving Clark).

    Death of Saluda Mustain Shelton
    She was the daughter of Thomas and Mary Haley Mustain. One of eleven children.The wife of Claiborn Shelton, and mother of nine children. When they were moving from Virginia to Indiana, they were in Ohio and Saluda took very ill she was no longer able to proceed on their journey to Indiana. So they stayed where they were in Ohio, the story goes they lived in a cave as there was no house there and she was too ill to travel. she passed away and was buried there near the cave. Much later Claiborn and two of the boys traveled on to live in Indiana.

    Enlisted 01 March 1862, at Frog Bayou, in Company A, McRaes Regiment Arkansas Infantry (Also known as 15th Arkansas Infantry Regiment Northwest).
    August 1, 1862 promoted to Corporal, Company A, Hobbs Regiment, Arkansas Infantry.
    Captured 10 May 1863 at the Battle of Champions Hill, Vicksburg Campaign.
    As POW was sent to Camp Morton, Indiana then to Fort Delaware, Maryland, and then to Point LookoutMaryland in September 1863. Stayed at point lookout until August 1864 when he was sent to ElmiraNew York to await prisoner exchange. Prisoner exchange October 1864.
    At GeneralHospital NO. 9 Richmond, Virginia. November 1864, then to CampLee.
    31 January 1865, transferred from 15th Arkansas to 53rd Virginia Infantry Regiment, Company G. This is interesting because Company G is commanded by his cousin from Virginia, R. A. Mustain and also serving in the company is his other cousin from Virginia Joel C. Mustain.
